Who actually needs an LMCT licence?

Under Victorian law, you can be deemed to be trading in motor cars even if you don’t think of yourself that way — the burden of proof is on you to show otherwise.

You likely need a licence if

  • You deal in four or more cars or trucks per year.
  • You buy vehicles with the intention of reselling for profit.
  • You advertise or operate as a car or truck yard.
  • You broker or facilitate vehicle sales for others.

You may be exempt if

  • You’re selling a small number of personal vehicles occasionally.
  • You fall under a specific exemption recognised by Consumer Affairs Victoria.

“LMCT” stands for “Licenced Motor Car Trader”, the official designation used in Victoria.

According to Consumer Affairs Victoria, generally if you deal in four or more cars per year, you need a licence — and in some circumstances a licence is required for fewer than four.

If you don’t hold a licence while carrying on a business of trading in motor cars, you may be subject to a criminal penalty. You can be deemed to be trading even if you don’t think you are — the burden of proof is on you to show otherwise. See exceptions here.
